These Terms of Service govern your access to and use of the Cheeky Shorts website, store, content, products, and related services. By using the store, you agree to these Terms and our Privacy Policy. Do not use the services if you do not agree.

1. Eligibility and accounts

You must be legally able to enter into a binding contract in your jurisdiction. You are responsible for information submitted through your account, maintaining account security, and activity conducted using your credentials.

2. Product information and availability

We aim to describe and display products accurately. Screen settings may affect colors, and minor variations may occur. Products, designs, sizes, promotions, and quantities may be changed, limited, or discontinued. We may limit or cancel orders where reasonably necessary, including suspected fraud, pricing errors, inventory errors, or unauthorized resale.

3. Orders, prices, and payment

Submitting an order is an offer to purchase. An order is accepted when we confirm acceptance or dispatch it. Prices, discounts, taxes, shipping fees, and the final total are shown at checkout. You agree to provide current and accurate billing, payment, and contact information. Payment is processed by Shopify and authorized payment providers.

4. Shipping, returns, and cancellations

Delivery is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy. Subscription, pre-order, and try-before-you-buy cancellations are governed by our Cancellation Policy. Mandatory consumer rights remain unaffected.

5. Intellectual property

The store’s branding, text, graphics, layout, photographs, videos, and other content are owned by or licensed to Cheeky Shorts and are protected by applicable intellectual-property laws. You may use the store only for personal, non-commercial shopping purposes. You may not copy, republish, scrape, sell, reverse engineer, or exploit store content without permission.

6. Acceptable use

You may not use the services for unlawful, fraudulent, abusive, harmful, or infringing activity; introduce malicious code; interfere with security or operation; collect others’ information without authorization; or attempt unauthorized access.

7. Third-party services and links

The store may include tools, payment services, apps, or links provided by third parties. Their services are governed by their own terms and privacy practices. We are not responsible for third-party sites or services except where applicable law requires otherwise.

8. Feedback and submissions

If you send feedback, ideas, reviews, photographs, or other content, you confirm that you have the necessary rights and that the content is lawful. You grant us a non-exclusive, worldwide, royalty-free license to use content you deliberately submit for store operation, support, marketing, and improvement, subject to applicable law and our Privacy Policy.

9. Disclaimers

Except for rights and warranties that cannot legally be excluded, the services and products are provided on an “as available” basis. We do not guarantee uninterrupted or error-free access, and delivery estimates are not guarantees.

10. Limitation of liability

To the maximum extent permitted by law, Cheeky Shorts and its service providers will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the services. Nothing in these Terms excludes liability that cannot be excluded under applicable consumer or other mandatory law.

11. Indemnification

To the extent permitted by law, you agree to indemnify Cheeky Shorts and its service providers against third-party claims arising from your unlawful misuse of the services, infringement of another person’s rights, or material breach of these Terms.

12. Severability, waiver, and assignment

If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the remaining Terms will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, sale, or transfer of the business.

13. Governing law

These Terms are governed by the laws of Poland, without limiting any mandatory consumer protections available in your country of residence. Disputes may be brought before courts having jurisdiction under applicable law.

14. Changes

We may update these Terms by posting a revised version on the store. Material changes will apply from the date stated in the update or as otherwise required by law.
